For more than four decades, regulation of seeds has been a subject of controversy, and, to date, there is no clear legislation defining the rights and duties of both the producers and breeders. Consequently, in the first part of this paper we analyzed the current mechanisms of property rights and its main problems. In the second part, we discuss the pros and cons of the new Seeds Act project, which seeks to amend the current legislation. Finally, the third part examines the alternative for seed producers and breeders to find their own regulation by private agreements, as well as the consequences and benefits that this brings to the sector; basically, the Monsanto Argentina S.A.I.C. company proposal is analyzed.</p> ER -
