The Right Not to Know the Biological Truth Against the Light of the Best Interests of Children and Adolescents In Colombia

The paternity investigation process, pursuant to Article 386 of the General Code of Procedure, in conjunction with Article 1 of Law 721 of 2001, imposes on the presiding judge the duty to order DNA testing as the appropriate mechanism to establish or exclude the investigated paternity. This prerogative is initially based on guaranteeing and protecting the fundamental rights of children and adolescents whose parentage is being investigated. However, there are certain factual contexts in which the application of this rule, contrary to guaranteeing the rights on which it is based, would lead to their violation. Therefore, and bearing in mind the best interests of children and adolescents as a guiding principle of judicial action, this analysis examines the possibility of protecting the fundamental rights of the minors in question when the biological truth is unknown and, consequently, the ordering and execution of DNA testing is not ordered.
