REFLECTION ON THE LEGAL POSITION OF THE NATIONAL AGENCY FOR PUBLIC CONTRACTING (COLOMBIA COMPRA EFICIENTE) REGARDING THE POTENTIAL COMPURRENCY OF CONSULTANT SELECTION MODALITIES

The regulatory entry that regulated the selection modality called minimum amount in public procurement brought a novelty in terms of opening the possibility of the figure "concurrence of modalities", consisting in that, for the same contractual need of the public administration and fulfilling certain types of characteristics, this modality could concur with those already existing in a specific case. The position of Colombia Compra Eficiente, which has been replicated in high Courts (Constitutional Court and Council of State), is simplified in that: 1. There is indeed a concurrence of selection modalities in these cases, and 2. The Merit Competition gives way to the Minimum Amount because this is a more expeditious, efficient and speedy modality, this in application of the principle contained in article 25 of law 80 of 1993.
