Abstract

FORMALIZATION OF CONTRACTUAL
BONDS THROUGH NOTARIAL AND
JUDICIAL MEANS OF SAME SEX
COUPLES IN THE CITY OF NEIVA.
The following article shows the outcome of the
investigation that contemplates as a problem to
determine, ¿what is the effectiveness of
formalizations of contractual bonds through
notarial and judicial means of same sex
couples in the city of Neiva a year after the
effective date of what the Constitutional Court
ordered in their sentence C-577/2011 and what
is the reason behind this result?, development
carried out from the descriptive research
approach where data was collected from the
number of formalizations held in the city and
later an instrument (interview) was applied to
the LGTBI community of the city of Neiva,
where they were asked about their knowledge
regarding the decision by the Court,
establishing the impact of the figure created by
the sentence, finding the lack of effectiveness,
the arguments for which the officials do not
apply it and why the LGTBI community does
not resort to the application of this figure;
allowing to conclude that there is not only a
normative void, but also a social one, calling
the civil servants to the implementation and
recognition of the rights of this community.
